Our current New York State Constitution falls short in ensuring equality for all citizens, lacking comprehensive protections against discrimination. Groups historically targeted, such as individuals with disabilities, LGBTQI+ individuals, immigrants, women, and pregnant people, are particularly vulnerable.
To address this, the NYS Equal Rights Amendment has been proposed to expand equal protection to marginalized communities. Passed by the legislature, it awaits public voting during the general election on November 5, 2024.
This amendment aims to prohibit discrimination based on factors like race, disability, and gender identity, explicitly recognizing pregnancy-related discrimination as sex discrimination. Its enactment would provide vital safeguards and defend against federal threats to women and LGBTQI+ rights.
